These Booking Terms and Conditions explain the contractual arrangements that apply when booking a safari or travel service through Asili Adventure Safaris & Travel Ltd.

They cover booking confirmation, payments, cancellations, third-party suppliers, travel insurance, baggage, documentation, financial protection and other important matters relating to your journey.

Please read these conditions carefully before confirming your Safari.

30% Deposit

A 30% deposit is required at the time of booking to secure your safari arrangements.

Final Payment

The full safari balance is due 60 days before the safari start date.

Travel Insurance

Comprehensive travel insurance is a strict condition of booking.

Kenyan Law

Our booking terms and conditions are governed by the laws of Kenya.

Booking Information

The following conditions form part of your booking agreement with Asili Adventure Safaris & Travel Ltd.

Definitions

In these Booking Terms and Conditions:

  • AAS or The Company refers to Asili Adventure Safaris & Travel Ltd, a Kenyan-based Destination Management Company offering holiday safaris across East Africa.
  • Safari means any holiday or travel service, or part thereof, booked through Asili Adventure Safaris & Travel Ltd.
  • Asili Adventure Safaris & Travel Ltd is a tour operator registered and licensed in the Republic of Kenya.
  • Agent refers to any supplier or travel agent seeking the services of AAS as a Destination Management Company in East Africa.
  • 3rd Party Supplier refers to any hotel, accommodation provider, airline, air charter company, ground transportation provider, boat operator or other independent contractor booked by AAS to provide part of a Safari.

Binding Agreement

All Safaris are subject to these Booking Terms and Conditions. By booking a Safari with AAS, the Agent acknowledges and accepts these terms as a binding agreement between the Client and Asili Adventure Safaris & Travel Ltd.

Booking a Safari

Safari enquiries are made by contacting AAS, after which an itinerary and quotation will be issued.

The itinerary and quotation must be confirmed in writing by the Agent. Once written confirmation is received by AAS, the Safari is considered booked.

AAS will then issue an invoice and the required deposit will become immediately due. From that point, these Booking Terms and Conditions, including the cancellation policy, become effective whether or not the deposit or full payment has been made by the required due date.

A Service Confirmation document confirming the trip arrangements will be issued after receipt of the deposit.

Payment Schedule & Charges

Deposit

A deposit equal to 30% of the total Safari cost is required at the time of booking to secure the Safari services.

Final Payment

Full payment of the Safari cost is due 60 days before the start of the Safari.

All bank charges associated with telegraphic or wire transfers are payable by the Client.

AAS reserves the right to cancel services where payment has not been received by the required payment date.

Cancellation & Cancellation Fees

Any postponement or cancellation of a Safari must be made in writing to AAS by the Agent. The cancellation or postponement becomes effective once AAS acknowledges receipt in writing.

US$500 per person handling fee plus all non-refundable deposits already paid to third-party suppliers.

31 – 60 days before Safari
50% of the full Safari cost.
30 days or fewer before Safari
100% of the full Safari cost.

AAS will make its best endeavours to recover non-refundable deposits already paid to third-party suppliers on behalf of a Client where possible.

AAS does not provide refunds or compensation for loss of travel time, substitution of facilities or amendments to an itinerary after departure where the circumstances are beyond the control of the Company.

Cancellation in Special Circumstances

In special circumstances such as bereavement, accident or critical medical situations involving the Client or their immediate family, AAS will make its best endeavours to refund monies received or postpone the Safari to a later date without penalty.

Such arrangements may depend entirely on the policies and discretion of third-party suppliers over whom AAS has no control.

Where a complete travel ban is issued by the Client's country of origin advising against all except essential travel to the destination, AAS will make its best endeavours to negotiate fair cancellation or postponement terms with relevant third-party suppliers.

Third-Party Suppliers

Third-party suppliers are independent companies and individuals with their own management and operations and are not under the direct control of AAS. Subject to applicable law, AAS cannot accept liability for cancellations, delays, events beyond the control of AAS or a supplier, personal injury, property loss or damage arising from the services of such independent suppliers.

Currency, Fuel & Other Fluctuations

AAS aims to honour confirmed Agent contracts and will only consider increasing a Safari price in exceptional circumstances arising from substantial exchange-rate movements, energy-price increases, government surcharges or similar external cost changes.

Liability

Clients should understand that safari travel involves certain inherent risks. By booking a Safari with AAS, the Client accepts those inherent risks.

While every reasonable care is taken to protect Clients and their property, AAS, its employees and agents accept no liability for accidents, injury, illness, loss or damage to property arising from a Safari booked through AAS, subject to applicable law and any liability arising from gross negligence or wilful misconduct by the Company.

Force Majeure

Force Majeure refers to circumstances beyond the reasonable control of AAS, including but not limited to acts of God, explosion, flood, severe weather, fire, accident, war or threat of war, sabotage, insurrection, civil disturbance, government intervention or other extraordinary events.

Where AAS is affected by Force Majeure, the Company will notify the Client regarding the nature and extent of the circumstances.

AAS will not be considered in breach of these terms for delays or failure to perform its obligations where such delay or non-performance results from Force Majeure.

After investigating the circumstances, AAS will determine whether a Safari can proceed safely. Where a Client elects to cancel despite AAS determining that the Safari can reasonably proceed, the normal cancellation policy will apply.

Changes to Itinerary, Quotation & Terms

AAS reserves the right to substitute services or alter a Safari itinerary where the Company considers such changes necessary or advisable.

In exceptional circumstances, AAS may revise quotations, including where significant currency fluctuations, fuel costs or other major operational cost changes occur.

Where third-party suppliers amend their terms and conditions, AAS reserves the right to amend its Booking Terms and Conditions where reasonably necessary and will communicate relevant changes to the Agent.

Baggage

Temporary or permanent loss of baggage remains the responsibility of the Client and/or the carrier involved.

AAS will make reasonable efforts to assist in tracing and forwarding delayed baggage, but any costs incurred in doing so remain the responsibility of the Client or carrier.

Clients are responsible for observing all baggage weight limits communicated for their journey. Baggage exceeding permitted limits may be left behind or forwarded at the Client's own expense.

Airline weight allowances may include both checked baggage and carry-on luggage, including photographic equipment. Clients are encouraged to pack lightly and follow the baggage guidance supplied with their Safari arrangements.

Travel Insurance

It is a strict condition of booking that all travellers maintain comprehensive travel insurance.

Medical emergencies and evacuation
Trip cancellation and interruption
Loss of personal baggage

Travellers are responsible for ensuring that their insurance cover is adequate for the entire Safari.

AMREF Flying Doctors

AAS provides AMREF Flying Doctors evacuation cover, providing an air-ambulance evacuation service in the event of illness while travelling in Kenya and Tanzania.

Financial Security

Planning an African Safari represents a significant investment, and we understand the importance of protecting our Clients' payments.

Asili Adventure Safaris & Travel Ltd is a proud member of the Kenya Association of Tour Operators (KATO) Bonding Scheme.

The KATO Bonding Scheme is designed to provide financial protection to travellers booking through participating Kenyan tour operators, helping provide greater confidence from the time a Safari is booked until the journey is completed.

Client Travel Documents

It is the Client's responsibility to ensure that all required passports, visas, permits, health certificates, inoculations and other travel documentation required for the Safari are valid and obtained before travel.

AAS may provide general guidance on destination requirements, but Clients remain responsible for confirming requirements applicable to their nationality and passport with the relevant embassy, high commission or government authority.

Client Information

Travel Forms supplied following confirmation of a Safari must be fully completed and returned to AAS no later than 60 days before arrival. This information enables us to prepare the Safari correctly and provide appropriate assistance in the event of unforeseen circumstances.

Law & Jurisdiction

These Booking Terms and Conditions are governed by and construed in accordance with the laws of Kenya.

Any dispute requiring legal determination shall be subject to the appropriate courts and dispute-resolution procedures in Kenya, including arbitration where applicable.

Formal complaints or issues raised with AAS will be investigated and addressed within 30 days of receipt. Genuine compensation or settlements arising from an accepted complaint will be processed in accordance with the applicable resolution.
